Terms of the Digital Image Personal Use License
Digital artist & Photographer, Brian Roe (“Content Provider”) grants you a non-exclusive perpetual personal-use license to download and copy the accompanying image(s) or video(s) (collectively, “Media,”) subject to the following restrictions:
1. This license is for personal use only. Personal use means non-commercial use of the media for display on personal websites and computers, or making two image prints or two video copies for personal use. The Media may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The media may not be used in advertising. The media may not be resold, relicensed, or sub-licensed.
2. Title and ownership, and all rights now and in the future, of and for the media remain exclusively with the Content Provider.
3. There are no warranties, express or implied. The media are provided ‘as is. The Content Provider will not be liable for any third-party claims or incidental, consequential, or other damages arising out of this license or buyer’s use of the media.
4. This Licence will automatically terminate upon failure by you, the licensee, to comply with any of its terms. If this happens, you hereby agree to destroy all copies and archives of the media, to cease using the media for any purpose, and to confirm to the Content Provider in writing that you have complied with these requirements.
5. The Content Provider reserves the right to discontinue the license of the digital image media for any reason. Upon notice of any discontinuance of a license, you agree not to further use the discontinued Media.
6. The Content Provider reserves the right to commence legal proceedings if copyright infringement has ensued from unauthorised use of the media.
7. If images are printed, print size is limited to 12inches x 18inches (height 30cm x width 45cm). Printing in larger sizes may distort the image. If larger sizes are needed please contact the Content Provider for a special order and separate pricing.
